
For many years, Ruth Bader Ginsburg and Sandra Day O’Connor were the only two women on the Supreme Court. But then O’Connor retired. In 2006.
Apparently nobody told lawyer Noel Francisco this! While he was defending former Virginia governor Bob McDonnell in court on Wednesday, he answered a question by Justice Ginsburg with, “There are lots of other statutes that would prohibit precisely what you are suggesting, Justice O’Connor.”
The Hill reports that the courtroom “gasped.”
Ginsburg seemingly had a sense of humor about it, saying, “That hasn’t happened in quite some time.” Apparently this incited “a roar of laughter.” Damn, this audience is great.
“Justice Ginsburg. I am very, very, very sorry,” Francisco apologized.
